Chapter V

What Swedish law actually carries

Kidnapping, trafficking, exploitation and the sexual offences against children, with the sentence each one carries drawn to the same scale.

People ask what someone actually gets. It is a fair question and the answer is usually given badly, either as a vague sense that it is serious or as a number pulled from a range without saying which end. Here is every range, quoted from the statute, drawn against one axis so they can be compared.

Kidnapping

Seizing and carrying off or confining a child or anyone else, intending to harm them in life or health, to force them into service, or to extort. The offence is complete on the seizure and the intent; no harm need follow.

There is no aggravated degree of this offence. Swedish law has the ordinary degree and a lesser one, so anything written about aggravated kidnapping is describing a crime that does not exist. Because life imprisonment is in the range, kidnapping never becomes time-barred, and it can be prosecuted in Sweden without the act being criminal where it happened.

Human trafficking

Three elements, all required for an adult victim: an improper means, a trade measure (recruiting, transporting, transferring, harbouring or receiving), and a purpose of exploitation. The statute requires the means to have caused the trade measure.

Against a person under eighteen, no improper means is required at all. Negligence as to the child's age is enough: a perpetrator who did not know but should have does not escape. This mirrors article 3(c) of the Palermo Protocol.

Human exploitation

4:1 b

Exploiting a person in forced labour, work under plainly unreasonable conditions, or begging, through unlawful coercion, deception, or by taking advantage of their dependence, defencelessness or difficult situation. No trade measure is needed.

Introduced on 1 July 2018 to close a gap. Trafficking targets the trade measures and is complete before exploitation begins; this offence needs no trade measure and puts the exploitation itself at the centre. Here too, no means is required against a child.

Rape of a child

Sexual intercourse, or a comparable act, with a child under fifteen. Consent is irrelevant: a child under fifteen cannot give it. The section also covers children of fifteen to seventeen where the perpetrator is a parent or has the child in their care.

The maximum for the aggravated degree rose from ten years to twelve on 1 August 2026. Neither degree ever becomes time-barred, and the removal of the limitation period applies retroactively to acts not already time-barred when it came in.

Exploitation of a child through purchase of a sexual act

Obtaining a sexual act from a person under eighteen in return for payment. It applies even where someone else promised or paid, which is what catches the intermediary arrangements.

Reports rose 25 per cent between 2023 and 2024, and roughly a third of these cases involve some form of sugar dating. On 1 July 2025 the subsidiarity clause was removed, so the offence can now be charged alongside other sexual offences rather than only when nothing else fits.

Procuring

Promoting or improperly profiting from another person's casual sexual relations in return for payment. A landlord who does not act against a flat being used this way can be liable under the second paragraph.

Whether the offence is aggravated turns on scale, on significant profit, and on whether it involved a ruthless exploitation of another person. Since 1 July 2025 it also reaches acts performed remotely, without physical contact.

How far Swedish law reaches

Abroad, without the act being a crime there

Normally Sweden only prosecutes an act committed abroad if it was also criminal where it happened. That requirement is lifted for trafficking, and for the sexual offences in chapter 6 sections 1 to 6, 8, 9 and 12 when committed against someone under eighteen. A Swede who buys a sexual act from a child abroad can therefore be tried in Sweden even where local law permits it. Two limits are worth stating: section 6:11, buying a sexual act from an adult, is not on that list, and a prosecution for an act abroad needs authorisation, normally from the Prosecutor-General.

With no time limit at all

The whole chapter on limitation was replaced on 1 April 2025. Rape of a child and aggravated rape of a child never become time-barred, and nor does rape against anyone under eighteen, or any offence carrying life. The change applies retroactively to acts that had not already expired. Two limits: ordinary limitation still applies where the perpetrator was under eighteen at the time, and prosecutors take the view that the exemption cannot be stretched to acts charged as sexual exploitation of a minor before 2005, because that would read the list wider than it is written.

convictions for trafficking in Sweden, in 2023 and again in 2024

Against 228 reports in 2023 and 185 in 2024, with 13 and 18 prosecutions brought. Sweden has never secured a conviction for trafficking for forced labour.

Fifteen girls and seven boys, out of 430 people in total. The figure for children has fallen steadily from 54 in 2021. No authority in Sweden can formally establish that a person was trafficked outside a court process, so this counts what came to the authorities' attention, not what happened.

Down 12 per cent on 2024, but 26 per cent above 2016. Of these, 2,521 concerned children under fifteen. Eighty-nine per cent were against a girl. Reporting rises when awareness rises, so a change in this number is not by itself a change in what happened.

Swedish municipalities with no barnahus

Thirty-three barnahus cover 247 municipalities. A barnahus lets a child meet the police, prosecutor, social services and healthcare in one child-friendly place instead of being moved between them. There is no law requiring one.
